Тhe EU packaging rulebook changes completely in five days

On 12 August 2026, a regulation that replaces thirty years of European packaging law comes into force

Regulation (EU) 2025/40, known as the Packaging and Packaging Waste Regulation or PPWR, was published in the Official Journal of the European Union on 22 January 2025. It entered into force on 11 February 2025, replacing the Packaging and Packaging Waste Directive that had been in place since 1994. That directive allowed each EU member state to interpret its obligations differently. PPWR removes that flexibility entirely. From 12 August, the same rules apply identically in all 27 member states, with no transposition period and no country-level variation.

The regulation covers every company that manufactures, imports, distributes, or places packaged products on the EU market. That includes businesses based outside the EU selling into it. There is no exemption based on company size for the obligations that activate on 12 August.

What companies must be ready by Wednesday

Three categories of obligation come into force on 12 August specifically. The first is chemical safety. Manufacturers must demonstrate that substances of concern, including heavy metals and PFAS (per- and polyfluoroalkyl substances) compounds, are minimised in their packaging materials. The combined limit for lead, cadmium, mercury and hexavalent chromium is 100 milligrams per kilogram. For food-contact packaging, PFAS restrictions apply from the same date, set at 25 parts per billion for any single PFAS and 250 parts per billion for the sum. If total fluorine in a material exceeds 50 milligrams per kilogram, further investigation is required.

The second is documentation. Every manufacturer must hold an EU Declaration of Conformity and supporting technical documentation for every packaging format placed on the market from 12 August. This includes material specifications, laboratory test reports, and descriptions of how the packaging meets PPWR requirements. The documentation must be accessible to market surveillance authorities on demand.

The third is reuse systems. From 12 August, a reuse system for reusable packaging must be in place for certain packaging categories, particularly industrial and commercial packaging and takeaway food and beverages. Businesses in scope must offer reusable options and allow for refilling.

A rolling timeline, not a single event

Wednesday is the first deadline, not the last. The PPWR runs on a staggered schedule through to 2040. Harmonised labelling requirements arrive in August 2028. Design for recyclability and minimum recycled content thresholds apply from 2030. All packaging must achieve recyclability grade A or B by 2038. Member states must also reduce packaging waste per capita by at least 5 percent by 2030, 10 percent by 2035, and 15 percent by 2040, each measured against the 2018 baseline.

For businesses that have not started yet, the documentation requirement is the most urgent pressure point. Market surveillance authorities can ask for the Declaration of Conformity at any point after Wednesday. Having nothing ready is not a defensible position.
